Midterm Your midterm assignment will engage course readings as outlined in the midterm prompt to identify one or more social problems related to violence against women and gender non-conforming people and examine one or more policies that aim to address the issue.
Your midterm will consist of a series of short essays that are each answered using course readings to show how Crenshaw’s theory of “intersectional failure” can be applied to US courts and support systems for people who are vulnerable to gender-based violence. Do not use one reading more than once unless permitted in the question. It is expected that you will use five separate articles in your midterm.
Format requirements
Midterm essays must include short essays that examine five (5) scholarly readings from the course syllabus as identified in the midterm prompt. Each individual essay should be 300 words, single-spaced, typed, with one-inch margins, in Times New Roman, 12-point font, spell/grammar checked, and include a formatted bibliography. Quotations and citations do not count in the word count requirement.
Answer all of the follow questions – each essay should be 200 – 250 word with the word count in parentheses at the end of your short essay. Each essay must include evidence from the reading, a cited quote or paraphrased example.
1. Define and explain Kimberlé Crenshaw’s theory of “intersectional failure”. Then, use Crenshaw and [Catherine] MacKinnon’s “dominance” “sameness/difference” to explain how gender/race-based inequality exists in US courts and Court systems. Offer one specific example from the reading and explain.
2. Use one of the following readings [Nayan Shaw – or – ] to explain how the intersections of sex, gender, race, and sexuality, can make people vulnerable to “differential justice”. Offer one specific example from the reading and explain.
3. Use one of the following readings (H. Davis – or – Broadus] to explain how sex-at-birth classification is institutionalized as a measure to grant or deny people civil rights (access to health care, marriage rights, adoption rights, etc.). Explain how this is an example of intersectional failure and why. Offer one specific example from the reading and explain.
4. Choose one social problem analyzed in a reading and explain how violence against gender non-conforming people is explored in the reading (readings can include Amar, Shaw, or Katz). Offer one specific example from the reading and explain.
5. Using Julietta Hua’s article, explain how some lawyers attempt to script their clients testimonies to present them as “believable victims”. What is the purpose of the lawyers? What does morality have to do with these efforts – what are the lawyers trying to achieve? What happens to the right to consent of the client? Offer one specific example from the reading and explain.
